JUSTICE FOR THE CHAUPE FAMILY
Maxima Acuña de Chaupe, this brave peasant who lives in the Andes of northern Peru undergoes constant attacks from the mining company and the Peruvian state and for over 2 years because she refuses to leave her little property which is at the center of what will become the harmful mega mining project Conga (extention of the Yanacocha mine).
The August 10, 2011, employees of the company Yanacocha, accompanied by members of the DINOES (Peruvian special police) arrive in the property of the family Chaupe in Tragadero Grande, without an official mandate, they destroyed and burned the house with all the belongings of the family, the daughter of Maxima was hit with rifle butt and lost consciousness, his son was beaten violently and had to be hospitalized, these two people hold serious consequences of this horrible day.
The Chaupe family filed a claim against this action of the mining company, but their claim is dismissed, at the contrary, in October 2012, it’s is the company that attacks Chaupe family for usurpation of land, despite the titles of property and cadastral extracts presented by the family, they are condemned, in a travesty of justice, not only to leave their property, but also with a prison sentence of 3 years and ordered to pay a large indemnity to the mining company.
Fortunately the first judgment was overturned on appeal for want of form in July 2013. But the Judicial process is not finish and resumes this June 20, 2014.
Since May 5, all the members of Chaupe family, as other 46 people opposed to the mega-mining project Conga, are object of security measures from the Inter-American Commission on Human Rights (IACHR), but the Peruvian government refuses to apply this decision.
In addition to these various judicial processes, the family suffered for 3 years constant harassment from the company Yanacocha, threats of any kind, insults, constant surveillance, arbitrary detentions during their displacements, 3 years of hell.
Support the Chaupe family in its fight for their land, do not let them alone against a ruthless monster, do not allow a mining company to impose its law.
We urge that the persecutions against the Chaupe family stop, that all the measures for their protection are taken and a fair trial is insured.
